1. Campaign

1.1          This Umrah Journey – 5-Star Umrah Trip with Lisa Surihani & MizzNina (“Campaign”) is offered by Eternal Rewards Sdn. Bhd (“Eternal Rewards”) which is the owner and operator of the QalbyApp.

1.2          By participating in this Campaign, the participant (“You”) agree to be bound by the terms and conditions (“Campaign Terms”) mentioned herewith as well as any other terms and conditions that may applicable to you.

1.3          In addition, by participating in this Campaign, you agree to accept the QalbyApp’s decisions as final and binding. You should refer to QalbyApp should you have any questions, comments or issues related to the Campaign.

2. Campaign Details

2.1          Period

2.1.1      This Campaign commences at 12:00:00 AM on 6^th February 2023, and ends at 11:59:59 PM on 31^st July 2023. Entries after 11:59:59 PM on 31^st July 2023 will not be accepted unless the Campaign is extended by QalbyApp at its sole discretion.

2.2          Eligibility

2.2.1      This Campaign is only available to the registered user of QalbyApp (“Participants”).

2.2.2      Participants must meet the criteria below to be eligible to participate:

1. You are a Muslim (as non-Muslims are strictly prohibited from entering Mecca).
2. You are the permanent residents of Malaysia, Singapore or Brunei.
3. You are eighteen (18) years old and above as at the Campaign commencement date.
4. You must follow all the steps stated in the QalbyApp to participate in the Campaign and complete all the sign-up for via the designated link: https://www.qalby.io/hijrahhati
5. You have to submit the same email address that was used to register your account with QalbyApp to enter this Campaign.
6. You must hold a valid passport or a valid VISA that allows you to legally travel overseas and return to your respective resident and/or country.
7. You are NOT the employees, independent contractors, interns, officers, directors, and agents of Eternal Rewards (including Eternal Rewards’ respective affiliates, subsidiaries, advertising and Campaign agencies, suppliers, and their immediate family members and/or those living in the same household).

2.2.3      Participation in this Campaign is completely voluntary and is not intended for persons who  reside in areas that specifically prohibits participation.

2.2.4      The Campaign is subject to all applicable federal, state and local laws and regulations applicable in your respective countries. Your participation will be considered void where prohibited.

2.2.5      Participants must ensure that they complete their sign-up form truthfully and correctly. Eternal Rewards does not accept responsibility for false and/or incorrect information provided by participants.

 3             How the Campaign works

3.1          The Campaign is based on point system based on successful share of the Campaign on your social networks, where the entry is free of charge and Winners is determined via automated    engine which calculates the highest accumulated entries and/or points in determining the Winners.

3.2          The Campaign must be entered by submitting an entry using the link provided at https://www.qalby.io/hijrahhati. The entry must fulfill all requirements of the Campaign, as specified in Clause 2 above, to be eligible to participate. Entries that are incomplete or do not adhere to the rules or specifications of the Campaign may be disqualified at the sole discretion of QalbyApp. You must provide all the information as requested.

3.3          Upon successful entry, you may see various activities that will unlock additional steps for you to collect points when you share the Campaign via your respective social media accounts.

3.4          The probability of winning depends on the number of shares done by you on your social networks. One (1) successful share = five (5) points

3.5          You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules of the Campaign, your submission may be disqualified at the     sole discretion of QalbyApp.

3.6          After the Campaign Period, two (2) Participants with highest entries points will be selected as winners (“Winner”) under the supervision of QalbyApp.

3.7          The Winner will be notified within seven (7) days of the winner’s selection. The notification will   be communicated via email. Eternal Rewards and/or QalbyApp shall have no liability for a Winner’s failure to receive notices due to spam, junk e-mail or other security settings or for a Winner’s provision of incorrect or otherwise non-functioning contact information. If the Winner cannot be contacted, is ineligible, fails to claim the Prize within seven (7) days from the time Prize notification was sent, or fails to timely return a completed and executed declaration and release as required, the Prize may be forfeited and an alternate Winner selection will be conducted.

3.8          Receipt of the Prize offered in this Campaign by the Winner is conditioned upon compliance with any and all federal, state, and local laws and regulations. Any violation of these official rules by the Winner at the Eternal Rewards and/or QalbyApp’s sole discretion will result in the Winner’s disqualification as winner, and all privileges as winner will be immediately terminated.

4. Prize Description

4.1          The Winner entitles to a trip to Mecca for Umrah and travel to Madinah with Lisa Surihani & MizzNina subjected to terms mentioned in Clause 7.5 herein (“Prize”).

4.2          The trip accommodates only the Winner. The Winner could choose to bring one (1) person to travel with at its own cost to be discussed and agreed upon with Eternal Rewards.

4.3          The Prize includes a VISA application (if applicable), return flight tickets, hotel accommodation, foods (at the hotel) and transportation (based on the schedule determined by Eternal Rewards) during the trip in Makkah and Madinah.

4.4          The Prize is operated by Qalby Travel Sdn. Bhd. which is sponsored by Eternal Rewards.

4.5          The Prize must be claimed within the specified timeframe in clause 3.7.

4.6          The Prize cannot be redeemed for cash.

4.8          The Prize cannot be transferred to another person unless the Winner has obtained a written approval from Eternal Rewards.

4.9          QalbyApp’s decision on all matters relating to the campaign, selection of winners and prizes via the automated draw engine shall be final, conclusive and binding on all eligible Participants. QalbyApp shall not be obliged to give any reasons and no further correspondence and/or appeal to dispute QalbyApp’s decision shall be entertained.

5. Withdrawal from the Campaign

5.1          Participation in this Campaign is completely voluntary and Participants may withdraw from the   Campaign at any time by contacting QalbyApp.

5.2          If a Participant withdraws from the Campaign, they will lose all entries accrued.

5.3          Eternal Rewards and/or QalbyApp will not reinstate the accrued entries in the Campaign should a Participant elect to withdraw.

6. Privacy

6.1          By entering this Campaign, You understand and agree that Eternal Rewards and/or QalbyApp and anyone acting on behalf of Eternal Rewards and/or QalbyApp or its respective licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, voice,    likeness, image, statements about the Campaign, and biographical information for news, publicity, information, trade, advertising, public relations and any related purposes without any further compensation, notice, review, or consent.

6.2          By entering this Campaign, you give your consent to Eternal Rewards and/or QalbyApp where your personal information will be used accordingly. You shall agree and give consent for your   personal data to be collected, processed and used by QalbyApp and its subsidiaries in accordance with QalbyApp’s Privacy Notice to the extent necessary for the purpose of this Campaign including for its marketing and promotional activities. In compliance with the Personal Data Protection Act 2010, QalbyApp shall protect the personal data of the eligible Participants.

7. Miscellaneous

7.1          By entering this content, you represent and warrant that your entry is an original work of authorship, and does not violate any third party’s proprietary or intellectual property rights. If your entry infringes upon the intellectual property right of another, you will be disqualified at the sole discretion of Eternal Rewards and/or QalbyApp. If the content of your entry is claimed to constitute an infringement of any proprietary or intellectual proprietary rights of any third party, you shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless Eternal Rewards and/or QalbyApp from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which Eternal Rewards and/or    QalbyApp may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right.

7.2          By entering the Campaign, you agree to release and hold harmless Eternal Rewards and/or QalbyApp and its subsidiaries, affiliates, advertising and Campaign agencies, partners,   representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant’s participation in the Campaign and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) unauthorised human intervention in any part of the Campaign; (iii) electronic or human error in the administration of the Campaign or the processing of entries; (iv) technical errors of any kind,        including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (v) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (vi) printing errors; (vii) lost, late, postage due, misdirected, or undeliverable email and/or or any correspondence.

7.3          Each provision of these Campaign Terms is individually severable. If any provision is or becomes illegal, unenforceable or invalid in any jurisdiction, it is to be treated as being severed from these Campaign Terms in the relevant jurisdiction to the extent of that illegality,            unenforceability or invalidity, but the rest of these Campaign Terms will not be affected. The legality, validity and enforceability of the provision in any other jurisdiction will also not be affected.

7.4          The Campaign Terms are governed by and construed in accordance with the laws of Malaysia and shall be subject to the appropriate courts of Malaysia, without respect to conflict of law doctrines.

7.5          Eternal Rewards and/or QalbyApp reserves the right to alter, amend or terminate this Campaign, or any aspect of this Campaign, at any time and without prior notice to you. Eternal Rewards and/or QalbyApp may make changes to these Campaign Terms by posting the modified terms on our application or website. We recommend you revisit these Campaign Terms regularly, and by your continued use of our services, you accept the Campaign Terms as may be amended from time to time.

7.6          Any dispute or situation not covered by the Campaign Terms will be resolved by Eternal Rewards and/or QalbyApp’s management in a manner it deems to be fair to all parties. The decision will   be final and binding on all parties.

7.7          By participating in this Campaign, you agree that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Campaign, shall be resolved individually, without resorting to any form of class action, exclusively before a court located in Malaysia. Further, in any such dispute, under no circumstances shall You be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than actual out-of-pocket expenses (i.e. costs associated with entering the Campaign). You further waive all rights to have damages multiplied or increased.

7.8          This Campaign and any obligations owed by Eternal Rewards and/or QalbyApp pursuant to these Campaign Terms will be revoked or withdrawn from Participants who abuse the spirit or intent   of this Campaign or who breach the Terms of Service, Privacy Policy and/or any other terms issued on QalbyApp. Eternal Rewards and/or QalbyApp reserve the right to cancel or terminate the trade, and to cancel or withdraw the Campaign at any time in case of any suspected abuse of the Campaign.

7.9          Eternal Rewards and/or QalbyApp reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Campaign should virus, bug, non authorized human intervention, fraud, or other cause beyond the Eternal Rewards and/or QalbyApp’s control corrupt or affect the administration, security, fairness, or proper conduct of the Campaign. In such cases, Eternal Rewards and/or QalbyApp may select a winner(s) from eligible entries received before and/or after the action taken by Eternal Rewards and/or QalbyApp where appropriate. Eternal Rewards and/or QalbyApp reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Campaign or applications or website or violates these Terms & Conditions. Eternal Rewards and/or QalbyApp has the right, in its sole discretion, to maintain the integrity of the Campaign, to void entries for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Campaign rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Campaign may be a violation of criminal and civil laws. Should such an attempt be made, Eternal Rewards and/or QalbyApp reserve the right to seek damages to the fullest extent permitted by law.

7.10        The Campaign is in no way sponsored, endorsed, administered by, or associated with Facebook, Twitter, Instagram, Snapchat, YouTube, Reddit, Pinterest, LinkedIn or any other social networks   that are used to share the Campaign. You understand that you are providing your information to the owner of the Campaign and not to Facebook, Twitter, Instagram, Snapchat, YouTube, Reddit, Pinterest, LinkedIn or any other social networks.

7.11        By participating in the Campaign, You have affirmatively reviewed, accepted, and agreed to all of the terms and conditions related to the Campaign and QalbyApp.
